Anya has been writing and implementing Legal Aid software for over ten years and our Family Module reflects our objectives to make claiming Family work simple and fully compliant with the directives issued by the Legal Services Commission.

Family Legal Aid Billing Overview

Family Law work recorded is subject to the pay rates and fees for the Family Private and Family Care work schemes that were introduced in October 2007 and revised in May 2011 for Phase 2 Fixed Fees. Family Private work can be recorded at Level 1 and at Level 2 where cases classed as Children or Finance have the option of an additional level 2 settlement fee. The Claim 1A will include billed work for the Phase 2 Fixed Fees for the PFLRS and FAS schemes.

Family Care work can be recorded and Levels 1 and 2 for advice and negotiation respectively and at Level 3, for matters that have full representation claimed on the Claim 1A.

Level 1 and 2 work for Family Private and Family Care work shows on the CMRF screen. This screen can be checked for any errors or omissions before creating a SPAN file. Each Family Law file created in iLaw will be included on the CMSF, controlled matter start form, when the “worktype” is set and time records have been entered.

The Family Module also allows claims to be made for Family Mediation and private matters. There is full integration with iLaw Accounts so the work claimed for shows on the client ledger.

Family Phase 2 Fees PFLRS and FAS Schemes: May 2011

iLaw Case Management software is fully compliant all parts of Family Legal Aid billing including the Phase 2 Fees for Family Private work implemented in May 2011. iLaw provides the Family Practitioner clear assistance throughout the process so the correct claim made that is also the maximum allowable for the work performed.

PFLRS Claims

PFLRS billing shows the fees to be claimed for the aspects of the case time recorded, with the total of hourly rates if any aspect has gone exceptional based on the aggregate of the Level 3 and Level 4 fees to be billed. The fees are subject to the Court where the case is heard and whether your office is based in London or Nationally.

FAS Claims

Claims for Family Advocacy (FAS Scheme) present the iLaw user with the correct bolt-on fees for the FAS Activity recorded; whether this is for an Interim Hearing, Advocates Meeting or Final Hearing. When the work is billed it can be claimed with PFLRS work on the Claim 1A.

The Claim 1A is printed with any additional pages where multiple aspects are involved.
