Litigator Fee Scheme Revision August 2010

Evidence Provision Fee and Judicial Apportionment

The new evidence Provision Fee should be recorded in iLaw as a disbursement subject to Vat. There are two basic fees to be entered if the person you are acting for is subject to Crown Court Means testing:

  • Lower Evidence Provision Fee This is £45 + Vat which you claim if you have to provide 4 or less pieces of evidence of the client's income/outgoings over and above what you already had to provide at the Magistrates' Court.


  • Higher Evidence Provision Fee The other being £90 + Vat which you claim if you have to provide 5 or more pieces of evidence of the client's income/outgoings over and above what you had already provided at the Magistrates' Court. You also claim this fee if the client is self employed because of the implied nature that there is more work involved in providing the evidence required.
For LSC Online (CCLF), once you select the Magistrates' Court the Representation Order was granted by and the date it was granted this will determine which claim you enter; whether to include the evidence provision fee or not.

Version 5 of the LF1 will be included in the next service pack. There will be provision for the Evidence Provision Fee to be entered and you will also be required to confirm if there has been an order for Judicial Apportionment.

iLaw Service Pack 35 - July 2010

Service Pack 35 implements the July 2010 changes to the Prison Law scheme with fixed and graduated fees being introduced for advice and assistance and advocacy assistance matters respectively. There are also changes to Police Station ID scheme codes and fees along with new versions of some notable crime claim forms.

iLaw Service Pack 34 - April 2010

Service Pack 34 carries some major changes to claiming crime lower and crown court matters. The police station fixed fees for many of the schemes in England and Wales have been reduced although the exceptional case threshold has remained the same

Claims for Committal hearings in the Magistrates’ court have been revised with a fee being payable at the end of the crown court and claimed on the LF1. The advocates graduated fee module for producing claims on the 5144f has been revised to produce additional claims for confiscation hearings. A revision has been included to the claim for uplift on cases and the reduction to the fees payable where there was a retrial. This service pack also comprises recent changes to the Family forms and the April 2010 issues of Crime and immigration claim forms.

iLaw Service Pack 33 - January 2010

Service Pack 33 includes key inclusions to both the Crime and Family modules. The reporting process for the Immigration CMRF has also been updated after recent clarification concerning Detention Travel and Waiting costs.

The Crime Module now includes a report for all Litigators and Advocates Crown Court Graduated Fee Scheme claims. If you have not purchased the GradFees module for producing the advocates claim then only the Litigators Fee Claims will show. The Family module has been revised to let you create and print the CLSPOA1 for payments on Account for Claim 1 and Claim 1A profit costs and disbursements.

Vat Rate Change January 2010

The Vat Rate is due to change back to 17.5% on 1st January 2010. You are able to make the necessary changes to your iLaw Case Management, GradFees 3 and iLaw Advocate 2 software in the Vat Rates screen from the Setup option. Users of GradFees version 1 or 2 will need to follow a different procedure.

iLaw Case Management

1. Click on Setup from the main iLaw menu. Then select Vat Rates. When the screen opens make sure that the Standard Vat rate is selected on the left side of the screen. The Vat rates for this rate show in the Stored rates for Tarriff section. There will be two existing rows with the second having an effective date of 01/12/2008 at 15%. The Vat Rate with the most recent effective date will be the Vat Rate the system will use.

2. Click on Add New Rate. In the new row that has appeared, enter 01/01/2010 as the Effective Date and 17.5% as the Vat Rate (%).

You only need to enter this on one workstation. Remember that the Vat Rate applicable for claims and submissions will be dependant on the date entered for when the work concluded and you should also keep in mind that it is only when a matter has been billed that you see the vat rate calculate. True disbursements will also have to be checked in the billing screen as shown below.

1. Click on Setup from the task bar. Then select Vat Rates from the list of options. The Vat rates show in the Stored rates for Tarrif section. There will be two existing rows with the second one having an effective date of 01/12/2008 at 15%.

2. Click on Add New Rate. In the new row that has appeared, enter 01/01/2010 as the effective date and 17.5% as the rate.

GradFees 1 & 2 users

Make sure that you make the following change when you are to make a claim that has ended after 1st January 2010. Click on Setup and then Configure Setup Options. In the screen that opens, enter 17.5% in the Vat Rate box. Click on ok before you close the window.
