National Pro Bono week

Last week was National Pro Bono week, an opportunity for the legal profession to take pride in its very impressive commitment to volunteering.

With the support of the Law Society, LawWorks has surveyed the legal profession to find out what pro bono is being done, how it is supported in organisations and what the future might look like. Last week saw the launch of the LawWorks Pro Bono Survey 2012.

The report draws on responses from 118 legal practices, mainly from the high street (39%) and international (22%) firms. The majority are London based, but responses came from across England and Wales. Although there are very different approaches, the review found significant pro bono delivery across the breadth of the profession.

The survey looked into the manner in which organisations structure and deliver legal pro bono work. In 39% of respondent organisations pro bono is led by someone at partner level. No high street firms have dedicated pro bono managers.

The survey also explored the ways that organisations support and recognise pro bono. Lawyers are encouraged to undertake pro bono work in 49% of respondent organisations, required to do it in 12% and given incentives in 9%. The most common reply was that lawyers are left to decide for themselves. The vast majority of the larger organisations have a bonus scheme, and 48% of these recognise pro bono within that scheme. A number of smaller respondents indicated that pro bono is not recorded, and is provided to clients in response to need. Others replied that, although pro bono is not counted towards billable hours, it is counted as such in the appraisal process.

Among respondent organisations, 18% indicate that they often turn away pro bono requests, while just 3% are in a position never to do so. The most common sources of unsuccessful approaches are individual members of the public, either existing clients or cold calls. Reasons given for turning work away include lack of relevant expertise or capacity, lack of resources, conflict of interest, unmeritorious cases and also the confines of the firm’s pro bono policy. The vast majority of respondents who turn away requests for pro bono point the individual or organisation to an alternative source of assistance.

Respondents express a number of concerns about the impact of LASPO cuts, including the fact that many areas coming out of scope are very complex and therefore challenging for non-specialists to take on. There is clear concern that pro bono cannot and should not be seen as a substitute for legal aid. The vast majority of firms (78%) have made no plans as part of their pro bono activity to respond to the legal aid cuts. High street firms are the least likely to be prepared to offer pro bono services to help those no longer eligible for legal aid.

As to the future, the report says: “Pro bono is facing many challenges at the moment, with economic pressures not only impacting on the capacity within the legal profession to offer it, but also on the level of need on the part of individuals and organisations. At the same time, the predicted impact of LASPO on the existing infrastructure will contribute further to this pressure. Innovations such as ABSs are also leading to changes in the way that the legal profession is structured, particularly in the context of the high street. As pro bono resources are very scarce and outstripped by demand, it is even more important that detailed consideration is given to how it is deployed.”
